A Pittsburgh-based staffing firm titled Capital Healthcare Solutions Inc. violated federal law by withdrawing an offer of employment to a certified nursing assistant because he was HIV positive, according to a U.S. Equal Employment Opportunity Commission (EEOC) statement. The EEOC claims a job offer was rescinded one month after the nursing aide’s doctor noted in a medical form he was HIV positive. He was not restricted from performing the required job tasks, as long as “universal precautions” such as gloves and facemasks were used. The EEOC seeks to bar the company from engaging in disability discrimination in hiring, and it seeks monetary compensation. The AIDS Law Project of Pennsylvania also represents the nursing aide.
