In 2009, the Delhi High Court in India found that an 1861 law criminalizing adult consensual “carnal intercourse against the order of nature” was unconstitutional. A direct result of that ruling is a 50 percent increase in the past four years in locations providing HIV services for LGBT people. On December 11, the Supreme Court of India overturned the 2009 decision, which again subjects LGBT people to possible criminal prosecution. In response, a statement from the Joint United Nations Programme on HIV/AIDS (UNAIDS) calls on India and all countries to repeal such laws. The group argues HIV prevention and related services are made more difficult to deliver as a result of such laws.
