Custody Battle Over HIV Treatment for Baby in Minnesota

A legal battle has ensued between a Minnesota family who want to take their HIV-positive 4-month-old boy off antiretrovirals and the Mower County prosecutors who are demanding the baby stay on his medications, reports the Star Tribune. The Nagel family said that they fear their grandson might suffer on meds, and that they saved their now 22-year-old daughter’s life by taking her off treatment when she was young. Baby Rico’s custody first became an issue when his parents, Lindsey Nagel and John Martinez, missed a nutrition appointment for their son in January. Within days, child protection officials removed him from his family’s home, claiming he was medically neglected. County District Judge Fred Wellman must decide whether he can trust the child’s ongoing treatment to his family.

I attended the evidentiary hearing on this custody case. The family was and is complying with "recommendations" of treating doctors--the county abducted the baby illegally. The Nagels now have possession of Rico, but not custody. The family did not say they feared he would suffer on the meds--he is suffering already, having a two-minute seizure with every dose. Not mentioned here--Rico's mother, Lindsey, was taken off AZT at 22 months, is healthy, and gave birth to a healthy baby.
