A 25-year-old woman from Brooklyn, New York, has sued a major stock-photo company for $450,000 claiming emotional distress, the New York Post reports. Avril Nolan accuses Getty Images of improperly allowing her image to be used in a newspaper advertisement informing people with HIV about their rights, which was paid for by the state human rights division. The ad features the words “I am positive (+) and I have rights” next to her image. She claims the ad has hurt her personal and professional relationships. Nolan’s lawyer asserts that Getty had no written release or authorization to use or sell the photo. The photographer also said that Getty was given no release and that the image was originally used for a magazine editorial.
