Supreme Court Favors Roche in HIV Patent Lawsuit

The U.S. Supreme Court has ruled in favor of Roche in a patent lawsuit brought on by Stanford University, reports Bloomberg News. At issue were patents to testing methods for evaluating AIDS treatments. The methods were developed by a university researcher who also worked with an outside company, Cetus, later bought by Roche Holding AG. The researcher held agreements with both Stanford and Cetus. The dispute centered around a law that allocates patent rights among the government, investors and institutions that receive federal money and would have nullified the Cetus agreement. The courts ruled that due to language in the Stanford agreement, the Cetus agreement took priority and Roche was granted patent rights.
